Tip of the Day Strip a Second Mortgage

November 23, 2012. If you have a second mortgage against your house, you may be able to strip it in a Chapter 13 proceedings. Here’s how. If the balance on your first mortgage is more than the value of your house, you do not have to pay the second mortgage at all. You have to file a separate motion as part of the Chapter 13 in order to take advantage of this aspect of Chapter 13.
